PLEASE READ THESE TERMS CAREFULLY. Welcome to Xtok, a content-sharing platform operated by Indieline S.L. (Spanish Tax ID: B56433113) ("Xtok," "we," "us," or "Platform"), a company registered in Spain at Paseo Marques de Monistrol, 5, 28011, Madrid, Spain. By accessing or using the Xtok platform, including the website (http://xtok.one) ("Site"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you ("You," "User") and Xtok. If you do not agree to these Terms, you must not use the Xtok platform. The Platform is intended solely for adult users aged 18 and older. We also recommend reviewing our Privacy Policy, which governs the processing of personal data, as well as other applicable Xtok policies.
These Terms have been developed in accordance with industry best practices and applicable legal requirements, including the GDPR (General Data Protection Regulation of the European Union), CCPA (California Consumer Privacy Act), DMCA (United States Digital Millennium Copyright Act), and 18 U.S.C. §2257 (United States federal record-keeping requirements for adult content).
1.1. Acceptance of Terms. By using Xtok, you acknowledge that you have read, understood, and agree to comply with these Terms, as well as any other rules and policies of Xtok referenced herein. This includes, without limitation, the Privacy Policy and the Acceptable Content Use Policy. In the event of any conflict between these Terms and other documents, these Terms shall prevail.
1.2. Modification of Terms. Xtok reserves the right to modify these Terms from time to time. In the event of material changes, we will notify users by posting the updated Terms on our website and/or sending an email notification specifying the effective date of such changes. Your continued use of the Platform after the effective date of the changes constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must cease using Xtok and, if applicable, delete your account prior to the effective date of the changes.
2.1. Adults Only. The Xtok Platform provides access to content that may include explicit adult material. Registration and use of Xtok are permitted only to individuals who have reached the age of 18 (or the age of majority in your jurisdiction of residence if it exceeds 18). By registering, you confirm that you are at least 18 years old and possess full legal capacity to enter into this agreement.
2.2. Prohibition on Minors. Individuals under the age of 18 are not permitted to create accounts or otherwise use the Platform. We do not knowingly collect or process personal data from minors. If we become aware of a minor user on the Platform, such user’s account will be immediately suspended or terminated. We may also take legally mandated actions, including notifying competent authorities (see Section 7 below).
2.3. Other Restrictions. Use of the Platform is prohibited for individuals who are legally barred from receiving or viewing sexually explicit materials (e.g., in jurisdictions with applicable prohibitions) and for individuals previously removed or banned by us for violating these Terms. Furthermore, if you are required to register as a sex offender in any jurisdiction, you are prohibited from using Xtok.
2.4. Accuracy of Information. Upon registration, you agree to provide accurate and current information about yourself (including a valid email address and other requested data) and to keep such information up to date. Providing false information (e.g., age) to gain access to the Platform constitutes a violation of these Terms.
3.1. Account Creation. To access Xtok’s functionality, a User must create an account by providing the required information (e.g., email address, username, and password). You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. You must not share your password with third parties. If you suspect unauthorized access to your account, you must promptly notify Xtok support.
3.2. One User – One Account. Each user is entitled to create and use only one account unless otherwise expressly permitted by Xtok. Creating multiple accounts by a single individual without authorization (e.g., to circumvent restrictions or re-access the Platform after a ban) is prohibited and may result in the suspension of all associated accounts.
3.3. Profile and Customization. Upon registration, you may customize your profile (e.g., by adding an avatar or description). The use of offensive, obscene, or content-violating images in your profile is prohibited (see Section 6). Avatars and descriptions must not contain graphic nudity or materials that breach these Terms.
3.4. Security. Xtok undertakes reasonable efforts to ensure the security of the Platform but does not guarantee absolute protection. You agree to comply with security measures and refrain from actions that could compromise the security or functionality of the Platform (see Section 6 on prohibited actions for details). We are not liable for any damages resulting from unauthorized access to your account unless such access occurs due to our fault.
